These terms set out the basis on which Akar Kasih provides family law legal services and operates this website. We have tried to write them plainly. If anything is unclear, please write or telephone us before you proceed — we would rather answer a question early than have any misunderstanding later.

1. About This Website

This website is operated by Akar Kasih for general information purposes. Nothing on this website constitutes legal advice, and nothing here should be read as creating a solicitor-client relationship between you and the firm. Every family law matter is different, and the information published here describes our services in general terms only.

We take reasonable care to keep the content of this website accurate, but we do not warrant that it is complete, up to date, or free of error. Malaysian law changes from time to time, and pages may not reflect the most recent developments. We recommend you seek professional advice about your own circumstances rather than relying on any general description on this site.


2. Our Services

The services described on this website — Family Consultation with Adult Children Present, Application for Variation of Custody or Access, and Long-Term Family Plan with Annual Review — are available subject to a formal engagement. An engagement begins when we have confirmed in writing that we are able to act for you and when you have accepted our client care letter.

We reserve the right to decline an engagement where there is a conflict of interest, where the matter falls outside our areas of practice, or for any other reason consistent with our professional obligations. Declining an enquiry does not indicate any adverse view of your situation.

Fees and Payment

The fees listed on this website are our current standard fees and are quoted in Malaysian Ringgit (RM), inclusive of the firm's professional charges unless otherwise stated. They do not include court filing fees, disbursements, or any third-party costs, which will be set out separately in our client care letter.

Payment terms are as set out in the client care letter for your matter. We do not accept payment by cash for amounts above the threshold prescribed under Malaysian anti-money laundering regulations. We may request reasonable funds on account before commencing work.

Scope of Each Service

The scope of work for each service is described in the relevant service description on this website and will be confirmed in writing in your client care letter. Work falling outside the agreed scope — whether arising from new developments, additional hearings, or an expansion of the original instructions — may be the subject of a separate fee arrangement, which we will discuss with you before proceeding.


3. Your Obligations

To allow us to act properly on your behalf, we ask that you:

4. Confidentiality and Professional Privilege

All communications between you and Akar Kasih in the context of a legal engagement are subject to legal professional privilege and are kept strictly confidential. We will not disclose the content of your instructions or the details of your matter to any person outside the firm without your express consent, except where disclosure is required by law or by our professional obligations as advocates and solicitors.

Please be aware that communications sent through unsecured email channels may not be fully protected from interception. If you are concerned about the security of your communications, please speak to us about alternative arrangements.


5. Intellectual Property

All text, design, and other content on this website is owned by or licensed to Akar Kasih. You may print or download material from this site for your personal, non-commercial reference. In respect of legal services provided under a client engagement, our liability is subject to the terms of the client care letter and to such professional indemnity insurance as we maintain. We will inform you of any applicable limitation when we send you our client care letter.


8. Complaints

We aim to provide a service of good quality and we take all concerns seriously. If you are unhappy with any aspect of the service you receive, please raise it with the supervising partner of your matter in the first instance. We have a written complaints procedure, a copy of which is available on request.

If your complaint is not resolved to your satisfaction through our internal process, you may contact the Malaysian Bar Council, which oversees the professional conduct of advocates and solicitors in Peninsular Malaysia.


9. Governing Law

These terms, and any matter arising from the use of this website or from the provision of our services, are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising under or in connection with these terms.


10. Changes to These Terms

We may update these terms from time to time to reflect changes in our practice or in applicable law. The date at the top of this page indicates when the terms were last revised. We recommend checking this page periodically. Continued use of this website after any revision constitutes acceptance of the updated terms.
